Red Cross Debates If Virtual Killing Violates International Humanitarian Law


Ron2K writes in with a story about a Red Cross committee that is debating if people playing war video games should be subject to the same humanitarian laws as people in a real war. Seriously. “With 62 billion kills in Call of Duty: Black Ops alone, a committee of the Red Cross is debating whether the International Humanitarian Law is applicable to online gamers, and if they are violating it. From the committee’s site: ‘While the Movement works vigorously to promote international humanitarian law worldwide, there is also an audience of approximately 600 million gamers who may be virtually violating International Humanitarian Law. Exactly how video games influence individuals is a hotly debated topic, but for the first time, Movement partners discussed our role and responsibility to take action against violations of this law in video games.’ While it’s questionable if gamers themselves can be prosecuted for not obeying the Geneva convention, the Red Cross committee’s actions seem to be aimed more at game developers — as first person shooters become more realistic, do game developers have an obligation to include humanitarian elements?”

Bethesda’s ‘Scrolls’ Lawsuit Going Ahead

New submitter person46 writes “Bethesda’s lawsuit against Mojang, developers of Minecraft, is going to court. As you may recall, Bethesda is claiming copyright infringement over the title of Mojang’s upcoming CCG/board game Scrolls. Bethesda claims that the name and game concept are too similar to their well-known RPG franchise The Elder Scrolls. ‘[C]ourt documents show that Bethesda lawyers plan to use comments on Scrolls articles and videos from around the web to show how people will confuse Scrolls with The Elder Scrolls. He also added that they’ve captured screenshots of Scrolls’ trailer as a way of showing how Mojang has copied Bethesda because both Skyrim and Scrolls contain mountains.’ Mojang founder Notch had offered to settle the dispute with a friendly game of Quake 3, but apparently Bethesda wasn’t up for that.”

EA’s New User Agreement Bans Lawsuits

Bethesda Tells Minecraft Creator: Cease and Desist

dotarray writes with news that Notch, creator of Minecraft, has received a letter from Zenimax, parent company of Bethesda, demanding that he rename his company’s new game, which is called Scrolls. They claim it bears too strong a resemblance to The Elder Scrolls. Notch said:
“First of all, I love Bethesda. I assume this nonsense is partly just their lawyers being lawyers, and a result of trademark law being the way it is. … I agree that the word ‘Scrolls’ is part of that trademark, but as a gamer, I have never ever considered that series of (very good) role playing games to be about scrolls in any way, nor was that ever the focal point of neither their marketing nor the public image. The implication that you could own the right to all individual words within a trademark is also a bit scary. We looked things up and realized they didn’t have much of a case, but we still took it seriously. Nothing about Scrolls is meant to in any way derive from or allude to their games.”

Irish Judge Orders 13-Year-Old To Surrender Xbox

An anonymous reader writes “In Belfast a High Court judge has ordered a 13 year old to surrender his Xbox to the authorities. The boy was charged with a series of robberies and in the bail application the judge asked the boy what he owned that meant a lot to him. The teenager said it was his Xbox games system. The judge told the youth that the surrender of the Xbox would show him what it was like to have something he really valued taken from him.”

Video Game Free Speech Ruling Aftermath

On Monday we discussed the U.S. Supreme Court’s decision that a California law banning the sale or rental of violent video games to minors was in violation of the First Amendment’s free speech protection. By now, both sides of the debate have had a chance to respond to the Court’s ruling. Congressman Joe Baca and CA State Senator Leland Yee pledged to continue the fight for stricter controls on the distribution of violent games, while others cried, “think of the children.” Game industry groups were unsurprisingly pleased with the decision, but warned that this won’t be the end of it, and asked lawmakers to stop wasting time with such legislation in the future. An article at the NY Times points out how the ruling highlights the lack of clear evidence supporting either side of the debate, and Time notes the Supreme Court’s double standard, asking, “Why does the court treat violent images and sexual images so differently?” Finally, an editorial at Gamasutra reminds us that even though most game developers are breathing a sigh of relief, many would like to see the industry shift toward something more creative and meaningful than violence.

Court Upholds Blizzard’s Anti-Bot DMCA Claim, Denies Copyright Infringement

An anonymous reader writes “The Ninth Circuit reversed a $6.5 million judgment for Blizzard against MDY Industries, saying that making bots is not copyright infringement. The bad news for MDY? The court found that they did violate DMCA Section 1201(a)(2) (PDF), which prohibits trafficking in products that circumvent technologies designed to control access to copyright-protected works.”

Man Sues Rockstar Saying GTA:SA Is Based On His Life
