At the Midem conference Monday, Hed had some interesting things to say about how piracy has affected the gaming industry, and Rovio’s games in particular: ‘”We could learn a lot from the music industry, and the rather terrible ways the music industry has tried to combat piracy.” Hed explained that Rovio sees it as “futile” to pursue pirates through the courts, except in cases where it feels the products they are selling are harmful to the Angry Birds brand, or ripping off its fans. When that’s not the case, Rovio sees it as a way to attract more fans, even if it is not making money from the products. “Piracy may not be a bad thing: it can get us more business at the end of the day.” … “We took something from the music industry, which was to stop treating the customers as users, and start treating them as fans. We do that today: we talk about how many fans we have,” he said. “If we lose that fanbase, our business is done, but if we can grow that fanbase, our business will grow.”‘”

MojoKid writes “When an advance copy of Crysis 2 leaked to the Internet a full month before the game’s scheduled release, Crytek and Electronic Arts (EA) were understandably miffed and, as it turns out, justified in their fears of mass piracy. Crysis 2 was illegally download on the PC platform 3,920,000 times, ‘beating out’ Call of Duty: Modern Warfare 3 with 3,650,000 illegal downloads. Numbers like these don’t bode well for PC gamers and will only serve to encourage even more draconian DRM measures than we’ve seen in the past.”

“Ubisoft is known for laying the blame for many problems on the unauthorized downloading of its games. Stanislas Mettra, creative director of the upcoming game I Am Alive, confirms this once again by saying that the decision not to release a PC version is a direct result of widespread game piracy. However, those who look beyond the propaganda will see that there appears to be more to the story than that.”
Another Ubisoft employee made similar comments about upcoming Ghost Recon games. Regarding Ghost Recon Online being free-to-play: “We are giving away most of the content for free because there’s no barrier to entry. To the users that are traditionally playing the game by getting it through Pirate Bay, we said, ‘Okay, go ahead guys. This is what you’re asking for. We’ve listened to you – we’re giving you this experience. It’s easy to download, there’s no DRM that will pollute your experience.’” Regarding Future Soldier having no PC version: “When we started Ghost Recon Online we were thinking about Ghost Recon: Future Solider; having something ported in the classical way without any deep development, because we know that 95% of our consumers will pirate the game. So we said okay, we have to change our mind.”

dartttt writes “Indie game company tinyBuild Games, who released a platformer called No Time To Explain recently, uploaded their own game to the Pirate Bay. However, there’s a key difference between the game they uploaded and the version you can purchase: the game characters wear pirate hats, and everything else has a pirate theme. One of the company’s founders, Alex Nichiporchik, said, ‘[S]ome people are going to torrent it either way, we might as well make something funny out of it. … You can’t really stop piracy, all you can do is make it work for you and/or provide something that people actually want to pay for. For us this is humor, we like making people laugh.’”

PktLoss writes “I’m interested in building an arcade machine, following the footsteps of Cmdr Taco among many others. Not being all that interested in piracy, I need to find somewhere to buy games. StarROMs used to be the kind of thing I was looking for, though with an incredibly short catalog. The MAME people have a few available for free (non-commercial), but this isn’t going to sate my needs. There’s an entire cottage industry supporting this goal. People are ready to sell me plans, kits, buttons, joy sticks, glass marquees, and entire machines. That’s fantastic, but where can I get the games? I refuse to believe that this entire industry is built on piracy.”

An anonymous reader writes “A new study (abstract) published at the annual ACM Foundations of Digital Games conference by researchers from Copenhagen Business School and the University of Waterloo explores the magnitude of game piracy on public BitTorrent trackers. The researchers tracked 173 new game releases over a three-month period and found that these were downloaded by 12.7 million unique peers. They further show that the number of downloads on BitTorrent can be predicted by the scores of game reviewers. Overall the current paper gives a seemingly robust overview of the state of game piracy on BitTorrent. Although the results may not be all that surprising, it’s certainly refreshing to see a decent report on BitTorrent statistics every now and then.”

tekgoblin writes “Sony has stepped up its stance on anyone circumventing protection of any kind on the PlayStation 3 and released a statement addressing it. Most recently Sony had barred George Hotz (Geohot) from releasing any more information about the console whatsoever. Now, Sony has their eyes set on other users that may be trying to use pirated software or modded PlayStation consoles on their network. The statement reads: ‘Notice: Unauthorized circumvention devices for the PlayStation 3 system have been recently released by hackers. These devices permit the use of unauthorized or pirated software. Use of such devices or software violates the terms of the “System Software License Agreement for the PlayStation 3 System” and the “Terms of Services and User Agreement” for the PlayStation Network/Qriocity and its Community Code of Conduct provisions. Violation of the System Software Licence Agreement for the PlayStation 3 System invalidates the consumer guarantee for that system. In addition, copying or playing pirated software is a violation of International Copyright Laws. Consumers using circumvention devices or running unauthorized or pirated software will have access to the PlayStation Network and access to Qriocity services through PlayStation 3 system terminated permanently.’”

iDuck writes “When Wolfire Games released their animal martial arts game, Lugaru HD, on the Mac App store, they could be forgiven for thinking they were seeing double. A counterfeit version of the software is currently available on the app store at a much lower price point under the name Lugaru. The best bit: as yet Apple have not responded to Wolfire’s emails to rectify the situation. While the source to the game was GPLed, ‘the license made it very clear that the authors retained all rights to the assets, characters, and everything else aside from the code itself.’”

Stoobalou writes “Rumor has it that Sony is looking to the PC games market to help solve its growing piracy problem on the PlayStation 3 — with the introduction of serial keys to its games. According to ‘a very reliable source’ quoted by PS3-Sense, Sony is attempting to address the recent revelation that it failed to properly secure the private signing key for its flagship console — leading to clever tinkerers producing third-party firmware that allows unofficial software and illegitimately downloaded games to run on unmodified hardware — by looking to the PC retail market for solutions. Unlike the PS3, the PC doesn’t have a hardware DRM system built in to it — despite attempts by groups like the Trusted Computing Group, formerly the Trusted Computer Platform Alliance, to introduce such a thing — relying instead on software-based DRM and a surprisingly old-fashioned guarantee of a game’s uniqueness: a serial key.”

An anonymous reader writes “It appears that Ubisoft’s controversial DRM scheme launched last year that required players to have a permanent connection to the Internet has been patched to no longer stop the game when connectivity drops, though an Internet connection is still required when starting the game.”
